The Curtailer - Service Terms
These terms cover the Curtailer service: your account, your plan, your device, and what it does with your solar installation. Enewe's general terms cover the sale and delivery of the hardware itself.

1. Who these terms are between
These terms apply between Opslag Versneller BV, trading as Enewe ("Enewe", "we", "us"), and the business customer that orders the Curtailer service ("you"). They apply from the moment you place an order and for as long as you hold an account or operate a device.
The Curtailer is sold to businesses. Checkout requires a Chamber of Commerce number and a VAT identification number, and we do not contract with consumers through this site.
Enewe's general terms and conditions apply to the sale, delivery and warranty of the hardware. These service terms apply to the software service and to what the device does once installed. Where the two genuinely conflict on a point about the service, these terms take precedence.
2. Definitions
- "Device" - a Curtailer unit supplied by us, identified by the device identifier assigned to it before it ships.
- "Service" - the software, web application and data processing described in clause 3.
- "Threshold" - the electricity price you set, below which you want the Device to pause export.
- "Day-ahead price" - the hourly or quarter-hourly price published by the European power exchange for your bidding zone, as distributed by ENTSO-E.
- "Plan" - the tier and term you selected at checkout (Basic, Pro or SDE Pro).
3. What the Service does
The Service collects day-ahead electricity prices for your market, makes them available to your Device, and gives you a web application in which you can see your Device's status and set your Threshold. When the day-ahead price for the current interval is below your Threshold, the Device pauses export from your solar installation. When it is at or above your Threshold, the Device does not intervene.
The Threshold is yours. The Service applies it; it does not choose it for you, and it does not optimise, trade, or take a view on what your Threshold should be.
The Service is not a control or safety system for your installation, is not a metering or settlement system, and is not a substitute for any control your grid operator or supplier is entitled to exercise.
For Pro and SDE Pro plans, we also offer an additional service that tracks external tariffs and subsidy rates against preferences you set, and that can propose or apply automated changes to your Threshold on that basis. You remain responsible for the correctness of anything this additional service does - see clause 9.
4. Your account
You need an account to use the web application. You are responsible for keeping your credentials confidential and for everything done through your account. Tell us promptly if you believe an account has been compromised.
You are responsible for choosing a secure password.
One customer can hold several logins - for example, several people at the same company. Anyone signed in under your customer account can see and change the settings of every Device on it.
5. Devices, claiming and credentials
Each Device is registered with our systems and given its own credentials before it ships. Those credentials are what let it connect at all; a Device we have not registered cannot reach the Service.
You claim a Device to your account from the web application. Claiming transfers control of that Device to your account and removes it from any account that previously held it. Claiming is not the same as ownership of the hardware, which passes under Enewe's general terms.
We may replace a Device's credentials if we believe they have been exposed. We will tell you when we do, because a Device whose credentials have changed needs to be updated before it can reconnect.
6. Plans, term and renewal
Plans are sold for an initial term of one or three years, as chosen at checkout, and the whole amount for that term is charged once, upfront. At the end of the term, your plan renews automatically for another term of the same length, on the same basis, unless you give notice to end it before the current term expires - matching Enewe's general terms, under which the underlying agreement itself renews the same way. As under those general terms, you cannot end a term early once it has started; notice only takes effect at the end of the term it is given in.
The Basic tier is free of charge and does not expire, is not sold for a term, and does not renew. It provides threshold-based curtailment and manual control through the web application.
7. Fees
Prices are those shown at checkout and are exclusive of VAT unless stated otherwise. VAT is charged at the Dutch rate for customers established in the Netherlands, and at 0% for customers who supply a valid VAT identification number in another member state. An offer shown with an expiry date is valid until that date only.
8. Availability
We aim to keep the Service available continuously, and to carry out maintenance that requires downtime outside daylight hours where we can. We do not commit to a service level, and we do not offer credits or refunds for downtime.
9. What you are responsible for
You are responsible for:
- installation of the Device, and for it being carried out by a competent person in accordance with the instructions supplied and applicable electrical regulations - whether you install it yourself or use an installer we introduce you to;
- checking that pausing export is permitted under your own arrangements, including your supply contract, any PPA, any subsidy scheme you participate in, and any agreement with your grid operator;
- the Threshold you set and its consequences;
- an internet connection at the site and the power supply the Device needs, and keeping the Device connected at all times. We notify you as soon as we detect that a Device has lost connectivity, and periodically for as long as it stays disconnected - but that notice is a courtesy, not a condition: keeping the Device connected is your responsibility whether or not we notice, or manage to tell you, that it has dropped off;
- the accuracy of the information you give us at checkout, including your VAT identification number, and telling us promptly about later changes that affect it - a change of contact details, company registration, or VAT number, for example;
- reviewing any automated change the additional service described in clause 3 makes to your Threshold. We notify you when it makes one; you remain responsible for checking it is correct, including where the change results from an error in our software or in the external tariff or subsidy data it relies on.

10. Estimates and simulations are not forecasts
The simulation tools on our site estimate what curtailment would have looked like over a past period, using historical day-ahead prices and historical weather observations, run through a general-purpose solar model. They do not use measurements from your installation, and they model rather than measure generation.
Actual results depend on your specific installation, its modules and inverters, shading, local grid conditions, the terms of your energy contract, and future prices - none of which we know.
11. Curtailment, and the limits of what we can promise
This clause is the one to read carefully, because the Service acts on your installation and that has financial consequences either way.
The Service depends on day-ahead price data published by third parties, on your internet connection, and on the Device's own operation. Any of these can fail. We therefore do not warrant that the Device will curtail on every interval below your Threshold, that it will never curtail on an interval at or above it, or that the prices it acts on are accurate, complete or current.
In particular, we are not liable for revenue you would have earned had the Device not curtailed, for revenue you did not earn because it failed to curtail, for the consequences of stale, delayed, incorrect or absent price data reaching the Device, or for the effect of curtailment on any subsidy, supply or grid arrangement you are party to.
We are equally not liable for damage arising from Service downtime, or for damage the Device causes to your installation or property, except where that damage results from our own intent or conscious recklessness - the same standard Enewe's general terms hold every exclusion in this document to.
12. Third-party data
Price data comes from ENTSO-E's Transparency Platform and weather data from national meteorological services. We pass this data on as we receive it. We do not verify it, we do not control its availability, and we are not responsible for its accuracy. Any use restrictions those sources impose apply to you as well as to us.
13. Acceptable use
You will not:
- attempt to access Devices, accounts or data that are not yours;
- extract, scrape or redistribute the price, weather or generation data in the Service other than for your own operations;
- reverse engineer, modify or replace the Device's firmware, except where you have a right to do so that cannot be excluded by agreement; or
- use the Service in a way that interferes with it for anyone else, or that breaches applicable law or the rules of your grid operator.
14. Personal data
We process personal data in connection with the Service as described in our Privacy Statement. Where you give us personal data about other people - for example a colleague's contact details, or an installation address that identifies someone - you confirm you may lawfully do so.
15. Intellectual property
We keep all intellectual property rights in the Service, the web application and the Device's firmware. You get a non-exclusive, non-transferable right to use them for your own operations, for as long as these terms apply. Buying a Device buys the hardware; it does not transfer any rights in the software running on it.
Data your Device reports remains yours. You give us the right to process it to operate and improve the Service, and to use it in aggregated, anonymised form that does not identify you or your installation.
16. Changes
We may change the Service, including by adding, altering or withdrawing features, and we may update the Device's firmware. We will not make a change that materially reduces the core curtailment function during a term you have paid for, other than where we must for legal or safety reasons.
We will give you 30 days' written notice of any change to these terms.
17. Suspension and termination
We may suspend an account or a Device's access to the Service if we reasonably believe it is being used in breach of clause 13, if credentials have been compromised, or if we are required to. We will restore access once the cause is resolved. Where the reason allows it, we will tell you first; where it does not, we will tell you as soon as we can.
You may stop using the Service at any time. Because plans are paid in full up front, stopping does not by itself entitle you to a refund of the unexpired part of a term.
If these terms end for any reason, you do not need to return the Device unless we agree otherwise. Our intellectual property in it - its firmware, our trademarks, and everything else covered by clause 15 - remains ours regardless of what happens to the physical unit.
18. Warranties
We provide the Service with reasonable skill and care. Beyond that, the Service is provided as it is: we do not warrant that it will be uninterrupted or error-free, or that it will achieve any particular result for you.
The Device itself carries a one-year hardware warranty from delivery, as stated on our pricing page - see Enewe's general terms for the warranty itself and how a claim under it works.
19. Liability
Neither of us excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, and to clause 11, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings, or loss of data.
20. Force majeure
Neither of us is liable for a failure to perform caused by something outside our reasonable control, including but not limited to failures of the electricity network, of internet connectivity, or of the third-party data sources named in clause 12 - the same force majeure standard as Enewe's general terms, clause 11, including its right for either of us to dissolve in writing if the event lasts more than 90 days.
Whoever is affected by a force majeure event must tell the other as soon as they become aware of it.
21. Assignment
You may not transfer these terms without our consent, which we will not withhold unreasonably - including if you sell the installation the Device serves. We may transfer them to a group company or to a buyer of our business.
22. Version
This version has been in force since 20 August 2026. Archive each outgoing version - the terms that bind an order are the ones in force on its order date.
